Case dismissed on judge's no to video
THE CASE against a man accused of trespass on an electricity sub-station at Crane near Monageer collapsed after Judge Gerard Haughton ruled that video evidence could not be shown in the District Court.
ESB supervisor Pat Shannon from New Ross gave evidence that he did not give permission for accused, Andrew Cash (47) of 40 Landale Lawns in Tallaght, or anyone else to be on the premises on the night of August 5/6 last year. Garda Sergeant Mark Mills told the court how he responded to a call from a member of the public about intruders at the sub-station.
He went to Crane and discovered Cash walking away from the ESB installation.
The defendant discarded a glove at the side of the road. When asked about this, Cash said he had found the glove on the ground. He told the sergeant that he was in the area looking for his daughter and that he did not know what a sub-station was.
Mark Mills said that CCTV footage showed the defendant entering the ESB'S premises. However, he told the judge Haughton that there was no one in court to give evidence of downloading the video.
The judge ruled that the film could not be shown and he dismissed the prosecution.
